dc.description.abstractO presente estudo tratou da responsabilidade civil do médico por dano estético decorrente de cirurgia plástica e, consequentemente, do direito à indenização por parte da vítima do erro. Buscou-se oferecer contribuições quanto ao estudo deste fato cada vez mais recorrente em nosso país, que é o aumento no número de cirurgias com finalidades estéticas, algumas das quais, com relativa frequência, têm acarretado consequências danosas a quem as busca realizar. O objetivo perseguido foi tentar defender a possibilidade de indenização a dano estético decorrente de cirurgia plástica, em razão da responsabilidade civil do médico responsável, partindo de noções acerca da responsabilidade civil, além de analisar a natureza – se de meio ou de resultado – da obrigação do médico cirurgião, bem como conceituando o instituto do dano e delineando a responsabilidade civil médica nas cirurgias estéticas, demonstrando a legalidade da indenização devida a dano estético derivado de erro médico. A metodologia utilizada foi a pesquisa bibliográfica, considerada também como de fonte secundária, a qual compreende a análise da bibliografia já publicada sobre determinado tema, em livros, artigos, teses, periódicos etc. Ela tem por objetivo realizar o contato entre o pesquisador e o produto das pesquisas já realizadas sobre o tema de que irá tratar, em suma, o que se deu nesta pesquisa. Na cirurgia estética o objetivo do paciente é tão somente buscar uma melhora em sua aparência, tornar-se mais belo segundo os padrões estéticos. Portanto, a obrigação do médico é de resultado, pois ele deve chegar ao resultado almejado pelo contratante, tendo em vista que se comprometeu a isso. Quando se configurar uma obrigação de resultado, haverá presunção de culpa por parte do médico, e a ele caberá afastar essa presunção demonstrando a ocorrência de caso fortuito ou de força maior capaz de afastar a responsabilidade civil. Assim, quando os resultados estéticos ficarem longe do desejado, o entendimento da doutrina e jurisprudência no sentido de que se tratando de cirurgia estética a obrigação é de resultado e não de meio, devendo a vítima receber indenização corresponde ao dano estético sofrido.pt_BR

dc.abstractThe present study dealt with the civil liability of the physician for aesthetic damage resulting from plastic surgery and, consequently, the victim's right to compensation for the error. We sought to offer contributions regarding the study of this increasingly recurrent fact in our country, which is the increase in the number of surgeries for aesthetic purposes, some of which, with relative frequency, have had harmful consequences for those who seek to perform them. The objective was to try to defend the possibility of compensation for aesthetic damage due to plastic surgery, due to the civil responsibility of the responsible doctor, starting with notions about civil liability, besides analyzing the nature - if of means or result - of the obligation of the medical surgeon, as well as conceptualizing the Institute of Damage and outlining medical civil liability in cosmetic surgeries, demonstrating the legality of compensation due to aesthetic damage derived from medical error. The methodology used was the bibliographical research, also considered as a secondary source, which includes the analysis of the bibliography already published on a given topic, in books, articles, theses, periodicals, etc. It aims to make the contact between the researcher and the product of the research already done on the topic that will address, in short, what happened in this research. In cosmetic surgery, the aim of the patient is only to seek an improvement in their appearance, to become more beautiful according to aesthetic standards. Therefore, the doctor's obligation is of result, as he must reach the desired result by the contractor, in view of which he has committed to this. When an obligation of result is established, there will be presumption of guilt on the part of the physician, and it will be necessary to remove this presumption by proving the occurrence of a fortuitous event or of force majeure capable of dismissing the civil liability. Thus, when the aesthetic results are far from desired, the understanding of the doctrine and jurisprudence in the sense that in the case of cosmetic surgery the obligation is of result and not means, and the victim should receive compensation corresponds to the aesthetic damage suffered.pt_BR
