Título: O direito sucessório nas uniões estáveis homoafetivas

Resumo: O presente trabalho foi desenvolvido para demonstrar que não há motivos plausíveis para discriminação no que se refere aos relacionamentos homoafetivos, tendo como objetivo geral partir da defesa da equiparação de direitos entre os companheiros na união estável homoafetiva e os cônjuges no casamento, em decorrência da própria equiparação entre ambos os institutos jurídicos; sobretudo, os direitos relativos à sucessão. Para tanto, como objetivos específicos, buscou-se apresentar a evolução do instituto da família no direito brasileiro; caracterizar o instituto da união estável; abordar a união estável homoafetiva; delinear a união estável homoafetiva no panorama do direito de família; tratar dos direitos sucessórios atinentes ao casamento; e demonstrar a equiparação da união estável homoafetiva com o casamento, explicitando a inconstitucionalidade do art. 1790 do Código Civil. A problemática girou em torno da análise da questão da inconstitucionalidade do art. 1790 do Código Civil brasileiro, acerca da possibilidade de equiparação da união estável homoafetiva com o casamento civil para a aplicação das mesmas regras sucessórias. A hipótese consistiu na proposta de a união estável homoafetiva equipara-se ao casamento, inclusive no que implica às regras do Direito Sucessório. Assim, é possível a equiparação de ambos para a aplicação das mesmas regras sucessórias.Com o advento com da Constituição Federal em 1988, o Estado assegurou proteção não apenas à entidade familiar formada pelo casamento civil, mas também às entidades derivadas da união livre, à família monoparental, formada por apenas um dos genitores e seus descendentes, e, conforme se verá, à formada por pessoas do mesmo sexo. Ademais, defendeu-se a tese de que referido instituto alcança também as uniões homoafetivas. A união homoafetiva é aquela existente entre pessoas do mesmo sexo, configurando uma relação homossexual. O Supremo Tribunal Federal, no julgamento da ADI nº 4.227, da ADPF nº 132, em conjunto com o CNJ na Resolução nº 175 de 14 de maio de 2013, vinculou os demais diplomas no sentido de respeitarem e protegerem as famílias formadas por casais homoafetivos, conferindo a eles os mesmos direitos de casais heterossexuais, incluindo os direitos sucessórios. Necessário ressaltar que a possibilidade de casamento, além de conferir status formal às relações homoafetivas, também elevam a dignidade dessas relações. Não existem motivos aceitáveis para que haja discriminação aos relacionamentos homoafetivos, haja vista que se trata de relacionamentos tais como quaisquer outros, baseados no amor e no afeto, sendo, por conseguinte, objeto do mesmo tratamento que os demais relacionamentos heteroafetivos. Utilizou-se como metódo de pesquisa a revisão bibliográfica, em livros, artigos e periódicos que eventualmente tratassem do tema em análise.
Abstract: The present work was developed to demonstrate that there are no plausible grounds for discrimination in relation to homoaffective relationships, with the general objective of starting from the defense of the equalization of rights between the partners in the homoafetive stable union and the spouses in marriage, as a result of the between the two legal institutes; in particular, the rights relating to succession. Therefore, as specific objectives, we sought to present the evolution of the family institute in Brazilian law; characterize the institute of stable union; addressing stable homoaffective union; to delineate stable homoaffective union in the panorama of the right of family; dealing with inheritance rights pertaining to marriage; and demonstrate the equation of stable homoaffective union with marriage, explaining the unconstitutionality of Article 1790 of the Civil Code. The problem turned around the analysis of the unconstitutionality of article 1790 of the Brazilian Civil Code, about the possibility of equating the stable homoaffective union with civil marriage for the application of the same succession rules. The hypothesis consisted in the proposal of stable homoaffective union equated to marriage, including in what implies the rules of Succession Law. Thus, it is possible to equate both for the application of the same succession rules. With the advent of the Federal Constitution in 1988, the State ensured protection not only to the family entity formed by civil marriage, but also to entities derived from free union, one-parent family, made up of only one of the parents and their descendants, and, as will be seen, that formed by people of the same sex. In addition, the thesis was defended that said institute also reaches homoafetivas unions. The homoafetive union is that existing between people of the same sex, forming a homosexual relation. The Federal Supreme Court, in the judgment of ADI No. 4,227, of ADPF No. 132, together with the CNJ in Resolution No. 175 of May 14, 2013, bound the other diplomas to respect and protect families formed by homosexual couples, giving them the same rights as heterosexual couples, including inheritance rights. It is necessary to emphasize that the possibility of marriage, besides conferring formal status to homoaffective relations, also elevates the dignity of these relations. There are no acceptable grounds for discrimination against homosexual relationships, since these are relationships such as any other, based on love and affection, and are therefore subject to the same treatment as other hetero-affective relationships. The bibliographical revision was used as a research method in books, articles and periodicals that eventually dealt with the subject under analysis.
